1. general

As far as nothing to the contrary is agreed, our GTC apply for all business between the Postalm ski school and the customers ("contractual partners"). The object of the company is the operation of a winter sports school. This includes, in particular, services such as the provision of instruction in the skills and knowledge of skiing or snowboarding (without guaranteeing a specific training success) as well as guiding and accompanying customers in winter sports.

2. online offer

All offers and actions of the Postalm ski school are subject to change and non-binding. The Postalm ski school as "author" accepts no responsibility for the topicality, correctness, completeness or quality of the information provided. Liability claims against the author, which refer to any kind of damage of material or idealistic kind, which was caused by the use or non-use of the presented information and/or by the use of incorrect and incomplete information, are in principle impossible, if on the part of the author no as can be prove heavy fault is present. The Postalm ski school reserves the right to change, supplement or delete parts or the entire offer without separate announcement or to stop the publication temporarily or finally. Price lists are without guarantee. We are not liable for printing errors.

2.1 References and links

The author hereby expressly declares that at the time the link was set up, no illegal content was recognisable and known on the linked websites. The author has no influence whatsoever on the current and future design, content or authorship of the linked or referenced internet pages. The author hereby expressly dissociates himself from all contents of all linked or referenced Internet pages that were changed after the link or referencing was made. This applies to all links and references set within the author's own Internet offer as well as to all third-party entries in guest books, discussion forums, mailing lists etc. set up by the author.

2.2 Copyright and trademark law

The author endeavours to observe the copyrights of the graphics, sound documents, video sequences and texts used in all publications, to use graphics, sound documents, video sequences and texts created by himself or to use licence-free graphics, sound documents, video sequences and texts.

3. conclusion of contract

Reservations and bookings can be made in person on site, by telephone, online form or via email. The offers of the Postalm Ski School are subject to change.
Bookings are only considered to be firmly booked after confirmation by the Postalm ski school and with full payment by the customer.
The course card necessary for the course processing must be collected by the guest in the ski school office before the start of the service provision. In all cases it applies that the course card is only handed over after full payment of the course costs.
If we do not reach the minimum group size per level, we offer private lessons as a substitute.
If the group is reduced to less than 5 participants, we reserve the right to combine them or reduce the number of lessons. Changes of teachers due to flexible organization are possible.
The course ticket is not transferable. Unused course days expire!
All prices quoted by us are in Euro and, unless otherwise stated, are inclusive of VAT.

4. general conditions of participation

The contractual partner must inform the Postalm ski school truthfully and comprehensively about his abilities and experience in skiing and must independently ensure that the equipment corresponds to the state of the skiing technology and the external conditions. The course participant also has to inform the Postalm ski school about his physical abilities, in particular his state of health and any ailments.
Before the start of the lessons, the contractual partner must independently arrange for the ski equipment (in particular ski bindings) to be checked by a specialist company. Course cancellations due to the participant's non-existent or non-functional equipment will not be reimbursed.
The Postalm Ski School will divide groups for ski courses. Should the downgrading of the participant be necessary, the contractual partner must follow this decision. Otherwise the Postalm ski school is entitled to cancel the contract.
The contract partner must follow the instructions given to him by the Postalm ski school. Disregarding a warning entitles the Postalm ski school to dissolve the contract immediately. Participation in the services of the Postalm ski school under the influence of alcohol or drugs entitles the Postalm ski school to immediate cancellation of the contract. The contractual partner has no claim to a refund of the paid payment in the described cases of contract dissolution.
The customer agrees that the photographs taken in the context of the contract may be published.

5. liability regulations

In principle, the Postalm ski school is only liable according to the legal regulations for damages which are directly connected with the activity of the Postalm ski school and which were caused deliberately or through gross negligence. A corresponding liability insurance exists. Health insurance, accident insurance and liability insurance are the responsibility of the course participant.
In addition, the Postalm ski school is not liable in any case if the contract partner injures himself/herself, suffers damage or causes damage of any kind by disregarding the instructions, the FIS piste rules, other legal orders or regulations of these terms and conditions.

6. warranty

The contractual partner must notify any complaints immediately on site at the office in order to ensure remedy. In the event of culpable failure to notify, there is no entitlement to a reduction of the fee. Claims against the Postalm ski school must be made and justified in writing at the latest 4 weeks after they arise.

7. withdrawal

Group courses and private lessons take place in all weather conditions.
Withdrawal from the contract is possible until 14:00 hours of the previous day at the latest without incurring a cancellation fee. A reasonable handling fee will be charged for card payments. If the cancellation takes place at a later time, the Postalm ski school is entitled to demand the agreed tariff up to the extent of a full day.
In the case of group courses and private lessons which have already begun, a refund of payments made is only possible in the case of accident or illness, on presentation of the course card and with a medical certificate from a local doctor. The amount to be refunded will be recalculated on the basis of the services actually rendered for this period. In this case, the difference between the services paid for and those actually provided will be refunded.
In case of cancellation during a service in progress or in case of no-show on the agreed date, no refund will be made.
Weather-related cancellations and cancellations due to unforeseeable circumstances ("force majeure", cable car infirmity, accident) will not be compensated.
The course fee does not include the costs of using the lifts. All costs for the use of all lifts are borne by the course participant as contractual partner. The Ski & Snowboard School will not compensate for lost teaching time due to the breakdown of the cable car and lift facilities.

8. safety

Course participants are expressly informed that according to the Salzburg Provincial Sports Act 1988, LGBl No. 98/1987, children and adolescents up to the age of 15 years are obliged to use a ski or snowboard helmet in accordance with ÖNORM EN 1077:2007 when practising alpine skiing and snowboarding. In addition, the participants of the course have to acquire knowledge of the contents and the application of the current FIS piste rules and to comply with them

10. place of jurisdiction

For the decision of all disputes arising from this contract, the competent court at the headquarters of the Postalm ski school is exclusively responsible.

11. choice of law

Austrian law applies. The contractual language is German.

12. legal validity

Should individual provisions of these terms and conditions of business be invalid, this shall not affect the validity of the remaining provisions and of the legal transaction as a whole. The invalid provision shall be replaced by a provision which comes closest to the invalid provision in economic terms.
